Dersin Amaç ve İçeriği

Course Objectives: The aim of the Health Law course is to teach students the legal relationships, rights, and obligations that arise in the provision of healthcare services, and to enable healthcare professionals to evaluate their professional activities within the framework of applicable legislation, ethical principles, and patient rights. Within this course, topics such as the legal nature of healthcare services, patient rights, informed consent, the legal requirements for lawful medical interventions, the legal, criminal, and disciplinary liabilities of healthcare professionals, and medical malpractice are examined in order to help students recognize potential legal problems that may arise during the delivery of healthcare services and develop solutions in accordance with the law.
Course Content: The content of the Health Law course begins with an introduction to law, including the definition of law, its function in maintaining social order, the sources of law, and the distinction between public law and private law. The course then examines the fundamental concepts of health law, focusing on the legal framework of medical interventions, ordinary and special medical procedures, medical malpractice, and informed consent. It also addresses the contractual liability and criminal liability of physicians, as well as the liability of the administration arising from healthcare services. In addition, the course covers the rights and obligations of patients and physicians, and discusses contemporary topics such as the legal aspects of health technologies, pharmaceutical law, public health law, and global health law. Through these topics, the course aims to enable students to evaluate legal issues arising in the provision of healthcare services from a comprehensive perspective.

1) In its theoretical sense, health law is a field of law that examines the legal foundations, principles, and concepts governing healthcare services. In its factual (empirical) sense, health law refers to the concrete events and practical applications that arise during the provision of healthcare services.

1) The cognitive objective of the Health Law course is to enable students to learn the legal concepts, fundamental principles, and legislation that arise in the provision of healthcare services, and to gain knowledge about patient rights, the legal requirements for lawful medical interventions, the responsibilities of healthcare professionals, and the legal framework governing healthcare services.

1) The communicative aspect of health law refers to the conduct of relationships among patients, physicians, healthcare professionals, and healthcare institutions within a framework of clear, accurate, and legally compliant communication during the provision of healthcare services.

1) The learning competence of health law refers to enabling students to understand the legal issues that arise during the provision of healthcare services, to follow the relevant legislation, and to evaluate new legal developments emerging in the field of health.

1) The field-specific competence of health law refers to the ability to evaluate and analyze legal issues arising during the provision of healthcare services by taking into account the unique characteristics of the healthcare field.

1) The competence of independent work and taking responsibility in health law refers to the ability of students to independently analyze legal issues arising during the provision of healthcare services, to develop solutions by evaluating the relevant legislation, and to act with a sense of responsibility when facing legal situations encountered in the field of health.
